01 — Overview

These Terms of Service govern your use of whiteweaver.site and any services provided by ThermaWell LLC ("we", "us", "our") under the Whiteweaver brand. By accessing this website or engaging our services, you agree to be bound by these terms.

Whiteweaver is a web design and development brand operated by ThermaWell LLC, a limited liability company registered in the State of Montana and serving clients in the United States. References to "Whiteweaver" throughout this document refer to ThermaWell LLC acting under that brand name.

02 — Services

We provide website design, web development, e-commerce builds, landing pages, and related digital services to small and medium-sized businesses. Our pricing and delivery timelines are as quoted at the time of engagement.

• All project scopes are agreed in writing before work begins.
• Revisions are limited to the number specified in your package.
• Hosting fees ($50/month) are billed monthly after initial delivery.
• We retain the right to showcase completed work in our portfolio unless you request otherwise in writing.

03 — Payment

Payment terms are outlined in your project agreement. Generally:

• A deposit may be required before work commences.
• Final payment is due prior to site launch or handover.
• Recurring hosting fees are due monthly on the anniversary of your launch date.
• Late payments may result in suspension of hosting or services.

04 — Intellectual Property

Upon receipt of full payment, ownership of the final deliverables (design and code) transfers to you. We retain ownership of any proprietary tools, templates, or frameworks used in delivery.

You grant us the right to display completed work as part of our portfolio and marketing materials.

05 — Limitation of Liability

To the fullest extent permitted by law, ThermaWell LLC shall not be liable for any indirect, incidental, or consequential damages arising from your use of our services or this website.

Our total liability for any claim shall not exceed the amount you paid us in the three months preceding the claim.

06 — Governing Law

These terms are governed by the laws of the State of Montana. Any disputes shall be resolved in the courts of Montana, unless applicable law requires otherwise.

07 — Changes to Terms

We may update these terms at any time. Continued use of our services after changes constitutes acceptance of the revised terms. Material changes will be communicated via email where possible.

07.5 — SMS Communications

Whiteweaver may send SMS messages to prospects and clients who voluntarily provide their phone number through our website, consultation requests, project inquiries, or direct communications with us. These messages may include consultation scheduling, proposal notifications, project updates, service-related communications, and customer support messages.

• Message and data rates may apply.
• Reply STOP to opt out at any time.
• Reply HELP for assistance.
• Your mobile information will not be sold, rented, or shared with third parties for promotional or marketing purposes.
